State of Ohio Regulations for Wetlands Permitting and Banking

  • General State Isolated Wetlands Permit Level 1 Review (Category 1 or Category 2, one-half acre or less)
    • Time required for OEPA to determine application is complete = 15 days (6111.026)
    • Time required for a Level 1 review = 30 days (6111.022)
  • Individual State Isolated Wetlands Permit Level 2 Review (Category 1 greater than one-half acre or Category 2, greater than one-half acre but less than or equal to three acres)
    • Time required for OEPA to determine application is complete = 15 days (6111.026)
    • Time required for a Level 2 review = 90 days (6111.023)
    • Publish notice in newspaper, allowable time for comments and requests for public hearing = 20 days
    • If a public hearing is determined necessary, it must take place within 70 days after receipt of application.
  • Individual State Isolated Wetlands Permit Level 3 Review (Category 2 greater than three acres or a Category 3)
    • Time required for OEPA to determine application is complete = 15 days (6111.026)
    • Time required for a Level 3 review = 180 days (6111.024)
