    The Pittsburgh in-lieu fee program (ILFP) operates in one service area in northeast Ohio within the Upper Ohio Beaver 6-digit HUC watershed in the U.S. Army Corps of Engineers (USACE) Pittsburgh District. The Steam + Wetlands Foundation ILFP provides third-party compensatory mitigation for unavoidable impacts to wetlands & streams delineated as waters of the United States and waters of the State of Ohio. The ILFP may be used by permit applicants to satisfy the compensatory wetlands mitigation requirements of permits issued under Section 404 and 401 of the Clean Water Act, the Ohio Isolated Wetlands Permit Program (IWP, ORC 6111), and Section 10 of the Rivers and Harbors Act.

    For impacts to non-jurisdictional waters, the service area is as follows:

    • For impacts to isolated Category 1 wetlands of any size and isolated Category 2 wetlands authorized under a level 1 review, the service area  includes the entire Ohio portion of the Corps District where impacts are located(ORC §6111.022);
    • For impacts to isolated Category 2 wetlands greater than 0.5 acre and isolated Category 3 wetlands of any size, the service area  will encompass the 6-digit HUC service areas defined above for jurisdictional waters.

    Compensatory mitigation of impacts outside the service areas can be considered by the permitting agencies on a case-by-case basis consistent with applicable state and federal regulations and laws, including 33 CFR §325, 33 CFR §332, ORC §6111, and Ohio Administrative Code (OAC) §3745-1-54

S+W’s ILF program operates in two geographically distinct service area in the Pittsburgh District in northeast Ohio.

  • Pittsburgh South (HUC 05030106) – including the portion of the Little Muskingum-Middle Island (HUC 05030201) above the Hannibal Locks and Dam within the Pittsburgh District, and (HUC 05030101)
  • Pittsburgh North (HUC 05030103), and (HUC 05030102)

Additional Information About This Program

Consistent with state law and Ohio USACE and Ohio EPA guidance, compensatory mitigation for impacts to isolated and jurisdictional Category 1 wetlands of any size and isolated Category 2 wetlands of 0.5 acre or less may be mitigated at any ILF wetland mitigation project located within the Ohio portion of the Pittsburgh District provided that mitigation credits of the appropriate resource type are not available at an approved mitigation bank.
